Terms of Service

1. Subject of the contract

Registriert.ch is a service of WebMix Schindelholz (hereinafter WebMix). We offer customers automated monitoring of Swiss Internet addresses (.ch) that are scheduled for deletion. The aim is the automated registration of the address at the moment it is officially released by the registry.

2. Costs & success fee

Our service is consistently based on the success principle. Charges only apply in the event of a successful reservation:

• Monitoring service: CHF 59.00
• Annual fee for the Internet address: CHF 14.90

If the Internet address could not be obtained by our system for the customer, neither the service fee nor the annual address fee will be charged.

3. Disclaimer

WebMix uses high-performance systems but expressly cannot accept any liability for the success of the registration. A contract for the acquisition of the address only comes into effect upon successful confirmation by the registry.

WebMix accepts no liability for direct or indirect damages arising from the inability to register an Internet address — whether due to technical disruptions, delays at the registry or because a third-party system completed the registration process faster.

4. Payment conditions & advance payment

After successful registration of the address, the customer receives an invoice by e-mail. The following conditions apply:

• Payment term: 10 days after receipt of the invoice.
• Default: if the deadline is exceeded, the customer is in default. From the first reminder onwards, default interest of 5% per annum is due. WebMix is entitled to charge the customer reminder fees as well as any costs of debt collection and enforcement.
• Right to advance payment: WebMix expressly reserves the right to make execution of an order conditional on advance payment (prepaid account), in particular for new customers or larger order volumes.
• Binding nature & cancellation: acceptance of the offer concludes a binding purchase contract. The customer has no right of cancellation or withdrawal.
• Cancellation fee: if WebMix rescinds the contract due to non-payment or other non-performance by the customer, or if an amicable cancellation is exceptionally agreed, WebMix is entitled to demand, instead of performance, a cancellation fee (liquidated damages) of 20% of the agreed purchase price, but at least CHF 150. The right to claim higher actual damages and to insist on performance is expressly reserved.

5. Trademark rights

The customer bears sole responsibility for ensuring that the requested address does not infringe any trademark, naming or copyright rights of third parties. WebMix does not carry out any legal review.

6. Place of jurisdiction

The place of jurisdiction is Lucerne, Switzerland. Swiss law applies exclusively.

7. Changes to the Terms and prices

WebMix is entitled to update or adapt these Terms as well as the pricing structure at any time. For orders already placed, the Terms and prices in force on the website at the time the order was submitted shall apply.

8. Authoritative version

These Terms are published in several languages. In the event of any divergence in interpretation between the language versions, only the German version shall be legally binding.
